“Little

1. The property known as “Little River View”, situated at Lower Street, Horning, NR12 8AA, is offered for holiday rental subject to final confirmation (see point 3. and point 4. below) by Mrs Victoria Free (the owner), to the client.
2. To reserve the property, the client should complete and sign the supplied rental agreement and return it with the owner. The initial deposit (20 % of the rent due) should be sent either with the rental agreement or separately by bank transfer. Following receipt of the signed rental agreement and deposit, the owner will sign a copy of the rental agreement and send it to the client by post or e-mail.
3. The balance of the rent is payable not less than 8 weeks before the start of the rental period. If payment is not received by the due date the owner reserves the right to give notice by post or e-mail that the reservation is cancelled. The client will remain liable to pay the balance of the rent unless the owner is able to re-let the property. Upon receipt of full payment for the holiday, final confirmation will be sent to the client.
4. A £100 security deposit is payable with the balance of the holiday. This covers any damage to the cottage or its contents. On the day of departure, the caretaker of the property will confirm that no damage has taken place and the owner will refund the deposit by cheque or BACS payment (according to the preference of the client) immediately. If damage has occurred, the £100 security deposit will be retained until the cost of the damage has been established. Any remaining balance after the cost of the repair will be refunded to the client.
5. If the booking is made less than 8 weeks before the start of the rental period, the client will send the whole amount of the rental rate (plus the £100 security deposit) with this form or separately by bank transfer.
5. If the client has to cancel the booking at any stage, the owner will return any money received, minus bank charges and commissions, if she can re-let the property for that period.
6. The client leaves his car and/or boat on the property at his own risk, and the owner takes no responsibility for any vehicle or the contents of any vehicle.
7. The rental period shall commence at 3 pm on the first day and finish at 10 am on the last day.
8. If the client wishes to invite any person, over and above the number listed on the rental agreement, to stay overnight at the property, he must obtain written permission from the owner who reserves the right to make an appropriate charge. At no point must the number of people staying overnight at the cottage exceed four adults/children and one infant (sleeping in a cot).
9. The client agrees to be a considerate tenant, to take good care of the property and leave at the end of the rental period. Although the after-stay clean is included in the price of the rental, we would ask you to leave the cottage in an acceptable condition.
10. The client may in no circumstance re-let or sublet the property, even free of charge.
11. The client’s group should ensure they have arranged adequate personal insurance cover for all members of their party to cover all personal risks and liabilities, including cancellation. The owner does not carry personal accident liability, and this is an explicit condition of the rental agreement.
12. The owner shall not be liable to the client:
- for any temporary stoppage in the supply of public services to the property;
- for any loss, damage or injury which may result from adverse weather conditions or any other matters outside the control of the owner;
- for any loss or damage or inconvenience suffered by the client if the property is destroyed or substantially damaged before the start of the rental period. In any such event the owner shall immediately refund to the client all sums previously paid.
13. Under no circumstances shall the owner's liability to the client exceed the amount paid to the owner for the rental period.
14. The contract shall be
governed by English law in every particular, including formation and
interpretation, and shall be deemed to have been made in England.
